SNA-certified Employer of Record compliance
Learn what the SNA certification means for Employer of Record services in the Netherlands and how it helps reduce payroll, tax, and compliance risks.
Navigating the complexities of becoming a highly skilled migrant can be challenging, but understanding the requirements is the first step.
For companies in the Netherlands looking to attract top-tier talent from outside the EU, the Highly Skilled Migrant (HSM) program offers a streamlined and business-friendly route to bring in highly qualified professionals. Known in Dutch as the "kennismigrantenregeling", this program is designed to make it easier for employers to hire skilled employees from around the world, bolstering innovation and competitiveness in the Dutch economy.
The HSM program is a fast-track immigration process that allows companies to hire non-EU employees under simplified procedures, provided that certain salary thresholds and employment conditions are met. The program is administered by the Immigration and Naturalisation Service (IND) and is renowned for its efficiency compared to standard work permit procedures.
This program is particularly advantageous for sectors experiencing a shortage of skilled workers, such as technology, finance and engineering. By offering a more accessible pathway for skilled migrants, countries can maintain their competitive edge and foster economic growth.
Fast and Efficient Process
Once an employer is a recognized sponsor with the IND, the application procedure for the HSM residence permit can be completed in as little as two weeks. This rapid timeline is a significant advantage in today’s competitive talent market.
Clear Salary Criteria
The HSM program uses a clear set of gross monthly salary thresholds, which vary, depending on the applicant’s age and whether they have graduated in the Netherlands. This transparency simplifies compliance for employers.
Family Reunification & Partner Work Rights
Highly Skilled Migrants can bring their spouse or registered partner, who is allowed to work in the Netherlands without additional permits (an attractive perk for international candidates considering relocation).
Simplified Residency Extension
After the initial permit period (up to five years), extensions are straightforward if the employment conditions continue to be met.
Salary thresholds
The most important requirement for the permit is that the applicable salary threshold is met. There are three distinct salary levels (gross per month, excluding 8% holiday allowance) depending on the candidate’s age and status. You can find the different thresholds and corresponding salaries on our webpage HERE.
The salary must be competitive for the position, age, and experience of the employee.
Employment Contract
This must be for a duration that matches the intended stay. Fixed monthly salary (including any fixed allowances) must be guaranteed, paid directly by bank transfer into the migrant’s personal account every month.
Recognized Sponsor Status
While the program itself is designed to be employer-friendly, there is a key requirement that can act as a barrier for many businesses: only recognized sponsors with the IND are allowed to hire Highly Skilled Migrants directly.
Becoming a recognized sponsor involves a formal application process, fees and the need to meet certain reliability criteria. For startups, SME's or companies hiring international talent for the first time, this can be a complex and time-consuming step.
Employers of Record (EoR) with recognized sponsorship status can serve as a solution for businesses that are not (yet) recognized sponsors themselves. This means that while the employee is officially on the EoR’s payroll, they work full-time for your company. Through this arrangement, employers can benefit from the HSM program immediately, before recognized sponsorship status has been obtained.
